Artistwing

Terms of Service

Version 2026-10-25 · Legal

1. Who we are

Artistwing is supplied by Victoriny AB, Swedish corporate identity number 559032-0502, VAT number SE559032050201, address Birger Jarlsgatan 58, 114 29 Stockholm, telephone +46 70 745 20 80, email music@zebastianvictorin.com ("Victoriny", "we", "us").

2. The service

Artistwing is a web service for artists, managers and labels to plan releases and promote their own music. It includes workspaces for teams, a catalogue of songs and media, publishing of the customer's own content to channels the customer connects (such as Instagram, Facebook, TikTok and YouTube), outreach to curators, and analysis and creative tools. Some tools use machine learning, including generative AI. Features may differ between plans.

3. Customers: consumers and business customers

Your contracting party is the person or legal entity identified in the order or beta invitation. You are a Consumer if you are an individual acting mainly outside your trade, business or profession. All other customers are Business Customers. Selecting a business plan or describing yourself as a professional does not remove rights you have under mandatory consumer law. Where these terms say that something applies to Consumers, it prevails over inconsistent terms.

You must be at least 18 years old and able to enter into a binding agreement. If you accept these terms for an artist, band or company, you confirm that you are authorised to bind them. A manager or label must identify whom it represents and have authority for the relevant content, accounts and instructions. During the beta, accounts are by invitation only.

4. Accounts and workspaces

5. Your content and your rights to it

"Your content" means everything you or your team upload, connect or create in Artistwing: recordings, compositions, lyrics, artwork, photos, videos, texts, names, likenesses and data.

You warrant that you hold the rights needed for each use you ask Artistwing to make of your content, including master, composition, lyrics, samples, performers', synchronisation and advertising rights and the permissions of every person whose name, image or voice appears in it, and that no agreement you are bound by (for example with a label, distributor or publisher) prevents that use. A distributor's agreement or a social network's music library does not by itself give a right to use music in advertising, exported videos or on other platforms. Uploading does not waive moral rights or replace any licence required from a publisher, collecting society or platform.

You retain your rights in your content. You grant Victoriny a non-exclusive, worldwide, royalty-free licence, limited to providing the agreed service on your instructions, to store, reproduce, technically edit, create the promotional adaptations you request, transmit, publish and submit that content on your behalf. We may let the approved providers in the supplier register perform only the processing needed for those purposes. This is not permission to sell your masters, license your music to unrelated parties or use your identity in our own advertising. We do not use your content to train AI models. The licence ends when the relevant processing ends, except for restricted backups and legal retention as described in the Privacy Policy. Copies already lawfully published on a platform remain subject to that platform's terms and deletion controls.

For Business Customers only: you will indemnify Victoriny against reasonable, documented third-party losses to the extent caused by your breach of the warranty above. Victoriny must promptly notify you, reasonably cooperate and allow you to control the defence with suitably qualified counsel, and must not admit liability or settle at your expense without your consent. You may not settle on terms imposing admissions or non-monetary obligations on Victoriny without its consent, which may not be unreasonably withheld. Both parties must mitigate loss. The indemnity does not cover loss caused by Victoriny's own breach, unauthorised modification or unlawful use. For Consumers, liability is determined under applicable law and this indemnity does not apply.

6. AI outputs, your approval and disclosures

AI outputs may be inaccurate, incomplete, not unique or similar to other works, and may infringe rights. Check factual claims, rights, recipients and settings before you approve anything. No particular audience growth, placement, revenue or platform outcome is promised. As between you and Victoriny, you keep the rights in your inputs and we assign to you any rights we can lawfully assign in outputs created for you. This does not guarantee copyright, exclusivity or clearance of third-party rights. Pre-existing software, templates and third-party assets remain subject to their own licences, which we will identify where they restrict your intended use.

Nothing is published, pitched or submitted without your approval. For a post or video you approve the content, the channel and its settings. For curator outreach you approve the message and any single follow-up message, and choose the song and each recipient; the approved messages are then sent within your daily limit, and the follow-up is sent only if the recipient has not replied. Any broader automation must be specified, recorded and revocable. Connecting an account is not by itself an approval to act. Withdrawing an approval stops new actions; posts and emails already sent may not be retractable.

Disclosures. Artistwing does not add visible disclosures, or the platforms' fields for AI-generated or synthetic content (such as YouTube's altered or synthetic content setting or TikTok's AI-generated content setting), to what it publishes for you. Where the law or a platform requires a disclosure from you as the publisher, you are responsible for making it, and you can make it yourself on the platform. Artistwing only creates clearly stylised depictions of real persons, and only of persons who have authorised it; it never creates realistic impersonations, cloned voices or false endorsements. Victoriny remains responsible for obligations the law places on Victoriny itself. Consumers' statutory rights and our responsibility for our own breach are not affected.

7. Connected channels and third parties

Artistwing uses YouTube API Services. By using its YouTube functionality you agree to the YouTube Terms of Service. Google's Privacy Policy is at policies.google.com/privacy. You may revoke access in Artistwing and through Google's security settings. Revocation and deletion are described in our Privacy Policy.

The Meta Platform Terms, the TikTok Developer Terms and the Spotify Developer Terms and Developer Policy apply where relevant to the connected functionality. We request only the permissions needed for the features you enable, and we never ask for your platform passwords. Platform approval, account eligibility and quotas may limit availability. Access tokens are stored encrypted and used only for your workspace.

A Content ID claim or platform rejection is not a legal determination of infringement. We may pause disputed content and notify you; we will not file a counter-notification or make a legal admission on your behalf without your specific authority.

8. Outreach to curators and fans

Outreach must be lawful under the rules that apply to the sender and the recipient. Publication of an email address is not by itself consent. Before sending, you must record a permitted basis for each recipient, such as a curator's published invitation to receive the relevant submission, valid consent, or a business communication to a legal entity. Messages to individuals who have not invited submissions are not allowed. We may require evidence and refuse an unsupported instruction.

Each marketing email identifies the artist and sender, must not be misleading and tells the recipient how to stop further messages free of charge. Objections are applied before any further sending, including queued follow-ups. Fan newsletters require recorded, specific consent to the identified artist or label; purchased or scraped fan lists are prohibited. Form submissions must follow the form owner's invitation and terms; no access control may be circumvented, no fee paid and no additional licence accepted without your specific approval.

You are responsible for your marketing decisions and instructions; Victoriny is responsible for its own obligations. Neither party transfers its statutory responsibilities to the other. Replies sent to your workspace's Artistwing reply address are processed for your workspace. Sending from Gmail uses only the gmail.send permission, which does not let us read your inbox.

9. Plans, prices and cancellation

10. Consumers: right of withdrawal and complaints

Consumers may withdraw from the subscription without giving a reason within 14 days after the contract is concluded. Use the function labelled "Withdraw from this contract" at app.artistwing.com/withdraw, email music@zebastianvictorin.com, write to Victoriny AB, Birger Jarlsgatan 58, 114 29 Stockholm, or use the form below. A clear statement sent before the deadline is enough; the form is optional and no order reference is needed. In the online function you confirm your name, the contract and the email address where we send the confirmation, and then confirm the withdrawal. We confirm every withdrawal without delay by email.

If you withdraw, we refund all subscription payments received under that contract within 14 days of receiving your notice, using the same payment method unless you agree otherwise, without any fee. We charge nothing for your use of the subscription during the withdrawal period, and starting to use the service does not waive your right to withdraw. This promise does not shorten a longer statutory withdrawal period that applies if information was missing.

The service must conform to the contract and mandatory consumer law, including the updates needed to keep it conforming. Report defects to music@zebastianvictorin.com. You may be entitled to correction, a price reduction, termination, repayment and damages under applicable law.

Withdrawal form (complete and send it only if you want to withdraw):

11. Usage limits

Each workspace has limits, for example for storage, AI usage, rendering, emails and posts per day. When a limit is reached, the affected feature stops until the next period or until the limit is changed. We do not charge more than your plan without your prior express order.

12. Acceptable use

You follow our Acceptable Use Policy.

13. Personal data

How we process personal data about you is described in the Privacy Policy. When we process personal data in your content on your behalf, the Data Processing Agreement applies and forms part of these terms.

14. Changes to the service and to these terms

We may modify the service beyond what is needed to keep it conforming only for a valid reason, such as security, legal compliance or a necessary adaptation to a third-party interface, and without additional cost to Consumers. We will explain the change clearly. If a change negatively affects a Consumer's access or use more than insignificantly, we will give reasonable notice by email in advance, describing the change, its timing and the right to terminate free of charge within 30 days after the later of receiving the notice and the change. That right does not apply if we let the Consumer keep the unchanged, conforming service at no extra cost. Statutory refund rights remain.

We may amend these terms only for specified legal, security or necessary operational reasons. We give at least 30 days' notice of material changes by email, and you may leave before they apply; price changes follow section 9. Continued use does not make an unfair term valid or replace your express agreement where it is required. No change applies retrospectively to claims that have already arisen.

15. Suspension, export and termination

We may restrict a workspace or a feature only where necessary and proportionate to an identified breach, non-payment, legal duty or security risk. Where safe and lawful, we tell you the reason and the affected features first and give you a reasonable opportunity to correct the issue. Urgent restrictions may apply immediately, and we explain them promptly unless the law prohibits it. You may ask for a human review at music@zebastianvictorin.com. We give a statement of reasons where the Digital Services Act requires it. A lawful dispute or complaint is not by itself a ground for suspension.

Either party may terminate with effect at the end of a billing period, and either party may terminate with immediate effect for a material breach. On termination we stop future automated actions and revoke our access to your connected accounts. You then have at least 30 days to retrieve your content and personal data free of charge in commonly used machine-readable formats, including uploaded originals, generated deliverables, contact and consent records and campaign history, subject to others' rights and lawful restrictions. A security suspension may require a secure assisted export instead. Where switching rules under applicable law give you more, those rights apply. Deletion follows the Data Processing Agreement and the Privacy Policy; content already published on a platform is managed there. If we end a paid service without a breach by you, unused prepaid fees are refunded proportionately.

16. Liability and events beyond our control

For Business Customers, each party is liable for direct loss caused by its breach. Neither party is liable for indirect loss, such as lost profit or business opportunity. Reasonable costs of restoring data lost through our breach are not excluded merely because they concern lost data. Victoriny's total liability is limited to the greater of SEK 10,000 and the fees paid or payable for the service in the 12 months before the event that caused the claim. The cap does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or liability that cannot lawfully be limited. It does not limit the rights of data subjects or authorities, including under Article 82 GDPR.

For Consumers, liability and remedies follow mandatory law; the cap and the exclusion of indirect loss above do not apply. The limitations of AI outputs do not excuse a failure to follow an approved instruction or our own security, confidentiality or statutory duties.

A party is excused from a delayed obligation only to the extent an event beyond its reasonable control prevents performance and could not reasonably have been avoided or overcome. It must notify the other party, limit the effects and resume promptly. An ordinary supplier failure, lack of funds or a preventable security incident is not by itself such an event. If material non-performance continues for 30 days, either party may terminate the affected service and unused prepaid fees are refunded. Mandatory consumer rights are not affected.

17. Law and disputes

Swedish law applies. Consumers keep the protection of the mandatory law of the country where they live, where applicable, and may bring proceedings in any court that mandatory rules of jurisdiction allow; Victoriny may sue a Consumer only where those rules permit. Please contact us first so that we can try to resolve the matter. Consumers may also submit a dispute within its competence to the National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), www.arn.se, Box 174, 101 23 Stockholm, Sweden. We will take part in that procedure. Disputes with Business Customers are decided by Swedish general courts, with Stockholm District Court as the first instance.
